
ADVANCED PROBLEM SOLUTIONS: Residential Terms and Conditions

Effective Date: January 1, 2026
These Residential Terms and Conditions ("Terms") apply to HVAC, plumbing, drain cleaning, sewer, indoor air quality, water
quality, and related residential services provided by Advanced Problem Solutions, LC ("APS," "Company," "we," "our," or
"us") to the property owner, tenant, customer, or other person authorizing the work ("Customer," "you," or "your").
These Terms are incorporated into applicable APS estimates, proposals, service tickets, work orders, invoices, maintenance
agreements, and approved change orders.
By approving an estimate, electronically accepting a proposal, signing a service ticket, authorizing work, or otherwise
permitting APS to perform authorized services, Customer agrees to these Terms, subject to any cancellation or other
rights that cannot legally be waived under applicable law.
1. Scope of Services
APS provides residential services including:
Heating and cooling diagnostics
HVAC maintenance and repair
Furnace and air-conditioning replacement
Heat pumps and related equipment
Indoor air quality services
Plumbing diagnostics and repair
Water heaters and tankless water heaters
Fixtures, valves, piping, and related plumbing
Sump pumps and related equipment
Drain cleaning
Hydrojetting
Sewer and drain camera inspection
Sewer and drain repair
Water-quality equipment
Other services specifically identified in an APS proposal or service ticket
APS is responsible only for work specifically included in the authorized scope.
Work that becomes necessary because of concealed conditions, additional failures, code requirements, customer requests,
or conditions discovered after work begins is additional work and may require separate authorization and additional
charges.
2. Diagnostic, Dispatch & Service Fees
Diagnostic, dispatch, evaluation, inspection, and service-call fees are due for the professional service provided, regardless of
whether Customer approves the recommended repair.
A Customer's belief regarding the cause of a problem, an error code, another contractor's diagnosis, or a previously identified
failed component does not eliminate APS's responsibility to independently evaluate the equipment when APS is being asked
to repair, replace, or warranty the work.
APS may require its own diagnostic evaluation before recommending or guaranteeing a repair.
Unless expressly included in another service:
Drain camera inspections may be separately charged.
Leak detection may be separately charged.
Advanced system diagnostics may be separately charged.
Additional troubleshooting after an initial problem is corrected may be separately charged.
A diagnostic visit does not guarantee that every existing or future problem within a system will be discovered.

3. Upfront Pricing & Estimates
APS generally provides pricing or repair options before authorized work is performed.
Depending upon the service, APS may use:
Flat-rate pricing
Quoted pricing
Project pricing
Hourly pricing
Time-and-material pricing
When APS provides a flat-rate or quoted price, the price represents the complete professional service, not merely the
technician's time and the wholesale cost of materials.
APS is not required to separately disclose its internal:
Material cost
Labor cost
Labor hours
Markup
Overhead
Profit
Vehicle expense
Insurance expense
Training expense
Administrative expense
Customer has the opportunity to approve or decline an offered repair before authorized work begins, except where
additional work is necessary to address an immediate safety condition and is separately authorized.
4. Estimate Limitations
Estimates are based upon conditions reasonably visible and accessible when the estimate is prepared.
Unless otherwise stated, estimates are valid for 30 days.
Pricing may change because of:
Manufacturer price changes
Material increases
Equipment availability
Special-order requirements
Changes in scope
Code requirements
Unforeseen conditions
Customer-requested changes
Conditions that may not reasonably be discoverable before work begins include:
Concealed leaks
Corroded piping
Brittle piping
Collapsed drains
Root intrusion
Hidden electrical problems
Failed controls
Refrigerant leaks
Improper previous installations
Structural deficiencies
Damaged ductwork
Inaccessible equipment
Underground conditions
Multiple simultaneous equipment failures
APS will notify Customer when reasonably practical if additional work is recommended or required.
5. Authorization to Perform Work
Customer represents that Customer has authority to authorize work at the property.
Authorization may be provided through:
Written signature
Electronic signature
Customer portal approval
Email
Text message
Recorded verbal authorization
On-site authorization
Other documented approval
APS may rely upon authorization provided by the property owner or another adult whom APS reasonably believes has
authority to approve the work.
Unless otherwise required by law, once authorized work has been performed, Customer is responsible for payment even if
another household member later disagrees with the decision to authorize the work.
6. Deposits & Payment
APS may require a deposit before scheduling or ordering materials.
Unless another payment schedule is stated in writing, larger installations or projects may require approximately 50% upon
approval, with the remaining balance due as specified in the proposal.
Service and repair invoices may be due upon completion or according to the terms stated on the invoice.
APS may accept:
Credit card
Debit card
ACH
Check
Approved electronic payment
Third-party financing
Third-party financing is subject to the financing provider's separate approval and terms.
7. Special-Order Materials & Equipment
Deposits may be required for:
Furnaces
Air-conditioning equipment
Heat pumps
Water heaters
Tankless water heaters
Specialty plumbing fixtures
Custom equipment
Special-order parts
Non-stock materials
Subject to any applicable statutory cancellation rights, special-order or nonreturnable equipment and materials may be
nonrefundable after APS has ordered or committed to purchase them.
Nothing in this provision eliminates a Customer's cancellation or refund rights when applicable law provides otherwise.
8.Residential Equipment Cancellation & Deposit Policy
Equipment Deposits
A deposit may be required before Advanced Problem Solutions ("APS") orders equipment, reserves installation labor, obtains
permits, or purchases materials for an installation or replacement project.
All deposits and cancellation terms remain subject to any cancellation rights provided to the Customer by applicable
Iowa or federal law.
Customer Cancellation After Authorization
After any applicable statutory cancellation period has expired, or when no statutory cancellation right applies, Customer
understands that APS may begin committing funds and resources specifically for the Customer's project.
If Customer voluntarily cancels the project after authorization because Customer changes their mind, decides not to
proceed, or otherwise cancels for reasons unrelated to APS's failure to perform, APS may retain from the deposit amounts
reasonably necessary to cover costs and losses incurred as a result of the cancellation, including:
Equipment already ordered or purchased
Manufacturer or distributor cancellation fees
Special-order or nonreturnable equipment
Restocking charges
Shipping and freight charges
Permit or inspection fees already incurred
Financing or transaction costs that cannot be recovered
Materials specifically purchased for the project
Reasonable administrative and project-preparation costs
Other actual costs reasonably incurred in reliance upon Customer's authorization
Special-Order and Nonreturnable Equipment
Once equipment or materials have been specifically ordered for Customer's project and cannot reasonably be canceled or
returned without cost to APS, the amount of the deposit attributable to those equipment/material costs may become non-
refundable to the extent permitted by law.
Customer understands that HVAC and plumbing equipment may be ordered specifically for the property's size, application,
fuel type, voltage, configuration, efficiency requirements, or installation conditions and may not be readily usable on another
project.
Change of Contractor
Customer's decision to obtain a lower price, use another contractor, perform the work themselves, postpone the project, sell
the property, or otherwise change plans after authorizing APS does not require APS to absorb costs already reasonably
incurred for Customer's project.
Any refundable balance remaining after deduction of lawful cancellation-related costs will be returned to Customer.
APS Cancellation
If APS cancels the project without Customer default and without circumstances beyond APS's reasonable control, Customer
will receive any refund required under the agreement and applicable law.
Statutory Cancellation Rights
Nothing in this policy limits any cancellation or refund right that Customer is entitled to under applicable Iowa or federal law.
If a transaction is subject to Iowa's statutory three-business-day cancellation right, APS will honor a timely and valid
cancellation and refund payments as required by law.
9. Late Payments & Collections
Amounts not paid when due may be subject to lawful late charges, interest, or delinquency charges only to the extent
permitted by applicable Iowa law and disclosed in the applicable agreement or invoice.
APS will not impose a charge exceeding an applicable statutory limitation.
If an account becomes delinquent, APS may:
Suspend non-emergency service
Decline additional credit
Require advance payment for future services
Require outstanding balances to be paid before scheduling additional work
Refer an account for lawful collection
Exercise other lawful remedies
Customer may be responsible for reasonable collection costs, court costs, filing fees, and attorney fees only to the extent
authorized by contract and permitted by applicable law.
10. Scheduling
Scheduling and estimated completion dates are provided in good faith but are not guaranteed unless APS expressly agrees
otherwise in writing.
Schedules may be affected by:
Weather
Emergency service calls
Material shortages
Manufacturer delays
Transportation delays
Equipment availability
Inspection schedules
Permit delays
Utility interruptions
Labor availability
Customer delays
Site conditions
Events beyond APS's reasonable control
APS will make reasonable efforts to communicate material scheduling changes.
11. Cancellations & Missed Appointments
APS requests at least 24 hours' notice for appointment cancellations when reasonably possible.
Late cancellations, missed appointments, or appointments where APS cannot access the property may result in a reasonable
trip or cancellation charge when disclosed and permitted by law.
Cancellation charges do not override applicable statutory cancellation rights.
12. Property Access
Customer agrees to provide reasonable and safe access to:
HVAC equipment
Plumbing fixtures
Mechanical rooms
Electrical panels
Water shutoffs
Drain and sewer access
Crawlspaces
Attics
Basements
Exterior equipment
Other areas reasonably necessary to perform the authorized work
Customer should remove personal property obstructing reasonable access.
Additional labor caused by unusually restricted or inaccessible conditions may result in additional charges when authorized.
13. Utilities
Customer is responsible for providing functioning utilities reasonably necessary to perform the work, including:
Electricity
Water
Gas
Drainage access
APS is not responsible for delays caused by utility interruptions outside APS's control.
HVAC-SPECIFIC TERMS
14. HVAC System Performance
HVAC performance depends upon more than the heating or cooling equipment itself.
Performance may be affected by:
Duct design
Duct leakage
Airflow
Insulation
Windows
Building envelope
Solar exposure
Equipment sizing
Return-air design
Filter condition
Humidity
Thermostat location
Building construction
Existing installation deficiencies
Unless specifically included in APS's scope, APS is not responsible for correcting pre-existing duct, insulation, airflow,
structural, or building-envelope deficiencies.
15. HVAC Replacement & Proper Sizing
APS recommends evaluating equipment sizing and system conditions when replacing HVAC equipment.
Replacing equipment solely on the basis of the size of the previous equipment may not provide optimal results.
The quality of the installation, setup, commissioning, airflow, and ongoing maintenance materially affects equipment
performance, efficiency, reliability, and life expectancy.
Customer agrees to reasonably maintain equipment after installation.
16. Filters & Maintenance
Unless specifically included in an APS maintenance agreement, Customer is responsible for:
Routine filter replacement
Keeping outdoor equipment reasonably clear
Maintaining required airflow
Scheduling recommended maintenance
Following manufacturer operating instructions
Damage or failure caused by lack of maintenance may not be covered by APS or manufacturer warranty.
17. Refrigerant
Refrigerant is charged separately unless specifically included.
The exact quantity required may not always be known before service and addtional service time may be billed to obtain additional refrigerant.
The addition of refrigerant does not represent a guarantee that a system is leak-free.
If APS identifies or reasonably suspects refrigerant loss, APS may recommend:
Leak detection
Leak repair
Evacuation
Recovery
Component replacement
Additional testing
Those services may involve additional charges.
PLUMBING-SPECIFIC TERMS
18. Existing Plumbing Conditions
Existing plumbing systems may contain:
Corrosion
Scale
Brittle piping
Deteriorated valves
Improper fittings
Hidden leaks
Prior improper repairs
Code deficiencies
Aging fixtures
Normal and reasonable plumbing procedures may expose or cause an already weakened component to fail.
To the fullest extent permitted by law, APS is not responsible for failure of a pre-existing deteriorated component merely
because the failure becomes apparent while APS is performing properly authorized work.
19. Plumbing Deficiencies
When APS observes a condition that reasonably appears defective, unsafe, improperly installed, or likely to lead to future
failure, APS may identify the condition to Customer.
Such notification is provided to assist Customer and does not mean APS has inspected or certified the entire plumbing
system.
Customer remains responsible for deciding whether to authorize recommended corrective work.
20. Water Shutoff
Plumbing service may require shutting off water to part or all of the property.
APS is not responsible for reasonable interruption of water service necessary to perform authorized work.
If an existing shutoff fails or cannot safely operate because of pre-existing deterioration, additional repair may be required.
DRAIN & SEWER TERMS
21. Drain Cleaning
Drain cleaning is intended to restore or improve flow by removing or reducing an obstruction.
Drain cleaning does not guarantee that a drain or sewer will remain open permanently.
Recurring blockages can be caused by:
Roots
Grease
Scale
Foreign objects
Bellies
Broken piping
Collapsed pipe
Offset joints
Deterioration
Improper slope
Structural defects
Continuing misuse
Unless expressly stated in writing, drain cleaning alone does not constitute repair of the underlying pipe.
22. Drain Cleaning Warranty
Any drain-cleaning warranty is limited to the specific warranty stated on the service ticket or invoice.
Warranty eligibility may depend upon the service option selected.
APS may recommend a camera inspection to better evaluate the drain or sewer and determine the cause of a blockage.
Where an enhanced drain-cleaning warranty requires a camera inspection or other specified procedure, the warranty applies
only if those requirements are satisfied.
Unless otherwise stated in writing, there is no warranty against future drain blockage merely because a drain was
previously cleaned.
23. Drain Cameras
A sewer or drain camera inspection can provide valuable information regarding accessible interior pipe conditions and is
strongly recommended in appropriate circumstances.
A camera inspection may identify:
Roots
Cracks
Collapses
Offsets
Bellies
Obstructions
Deterioration
A camera cannot necessarily identify every defect, particularly when visibility or access is limited.
24. Drain Cables, Jetting & Existing Pipe Damage
Drain-cleaning cables, hydrojetting equipment, and similar professional equipment necessarily apply mechanical or water
force to piping.
Existing weak, cracked, corroded, improperly installed, or deteriorated pipe may fail or become further exposed during
normal drain-cleaning procedures.
APS is not responsible for pre-existing pipe deterioration or structural failure that becomes apparent during proper use
of drain-cleaning equipment, except to the extent damage is directly caused by APS's negligent performance.
25. Chemical Drain Cleaners
Customer must notify APS if chemical drain-cleaning products have recently been placed into a drain.
Chemical products may create a hazard to Customer and APS personnel and may damage plumbing systems.
Use of chemical drain cleaners after APS drain service may affect any applicable drain-cleaning warranty when the chemical
contributes to the failure or interferes with APS's work.
ACCESS, EXCAVATION & RESTORATION
26. Excavation & Access Work
Certain plumbing, HVAC, drain, or sewer work may require:
Excavation
Concrete cutting
Drywall removal
Ceiling access
Flooring removal
Cabinet access
Landscaping disturbance
Other access work
Unless specifically included in APS's proposal, APS's responsibility does not include cosmetic restoration such as:
Drywall finishing
Painting
Wallpaper
Flooring
Cabinetry
Tile
Concrete finish matching
Landscaping
Decorative surfaces
APS may provide contact information for other contractors as a courtesy, but unless APS expressly contracts to provide that
work, those contractors are independent parties and APS does not warrant their work.
PERMITS & CODE
27. Permits
APS will obtain permits when legally required and when APS is responsible for obtaining them under the applicable scope of
work.
Permit and inspection fees are included only when specifically stated or incorporated into the project price.
Customer agrees to provide reasonable access for required inspections.
28. Code Compliance
APS will not knowingly perform work in violation of applicable safety requirements or applicable codes.
Existing code violations that are unrelated to APS's contracted work are not automatically included in APS's scope.
If existing conditions or an authority having jurisdiction requires additional corrective work, APS will advise Customer when
reasonably practical and may issue additional pricing.
WARRANTIES
29. APS Workmanship/Labor Warranty
APS labor or workmanship warranty varies according to:
Service performed
Repair option selected
Installation package
Equipment
Maintenance or membership agreement
Specific written warranty terms
The applicable APS labor warranty, if any, is the warranty stated on the Customer's estimate, proposal, service
ticket, invoice, or separate written warranty.
If no APS labor warranty is expressly stated, Customer should not assume that future diagnostic or labor charges are
included.
30. Manufacturer Parts & Equipment Warranty
Manufacturer warranties are separate from APS's labor/workmanship warranty.
Manufacturer warranties are controlled by the manufacturer's:
Terms
Conditions
Exclusions
Registration requirements
Coverage period
Claim procedures
Approval
APS does not control whether a manufacturer approves a claim.
APS will reasonably assist Customer in processing an applicable manufacturer warranty for equipment or parts originally
provided or installed by APS.
31. Manufacturer Part Failure — Labor Is Not Automatically Covered
A manufacturer parts warranty generally covers the covered replacement part or equipment component only. It
does not automatically provide free APS labor.
If a manufacturer-covered component fails, Customer remains responsible for costs not expressly paid or reimbursed by the
manufacturer or covered by a separate written APS labor warranty.
Those costs may include:
Diagnostic service
Labor to determine the failed component
Removal of the defective component
Installation of the warranty replacement component
Refrigerant
Recovery and evacuation
Shipping
Freight
Manufacturer processing charges
Crane or lift
Travel
Disposal
Startup
Testing
Other materials or labor required to complete the repair
A manufacturer's decision to provide a replacement part does not create an obligation for APS to provide labor at
no charge.
Example
If a manufacturer approves a compressor, motor, control board, heat exchanger, valve, sensor, or other component as a
warranty part, the replacement part may be supplied by the manufacturer at no charge or reduced charge.
However, APS's diagnostic and installation labor remains billable unless the Customer has an applicable written
APS labor warranty or the manufacturer expressly reimburses APS for that labor.
32. Warranty Diagnostics
A request for warranty service does not automatically make the service visit free.
APS may need to diagnose the equipment to determine:
What failed
Why it failed
Whether APS workmanship caused the failure
Whether another component caused the failure
Whether manufacturer warranty applies
Whether maintenance requirements were satisfied
If the problem is not covered under an applicable APS labor warranty, normal diagnostic, labor, material, refrigerant, and
other charges may apply.
33. Warranty Exclusions
Unless a specific written warranty provides otherwise, warranty does not cover failure caused by:
Lack of required maintenance
Dirty filters
Misuse
Abuse
Neglect
Freeze damage
Flooding
Water damage
Lightning
Power surge
Voltage irregularity
Utility failure
Fire
Corrosion
Drain re-clogging
Roots
Structural drain defects
Chemical drain cleaners
Customer modification
Customer-supplied parts
Work performed by others
Vandalism
Acts of nature
Pre-existing conditions
Failure of unrelated components
Manufacturer warranties remain subject to the manufacturer's separate exclusions.
34. Customer-Supplied Parts & Equipment
Unless APS expressly agrees otherwise in writing, APS does not provide a parts warranty on Customer-supplied equipment or
materials.
APS also cannot guarantee another person's diagnosis.
If APS agrees to install a Customer-supplied part, APS's responsibility is limited to APS's specifically stated workmanship
warranty.
Additional labor caused by an incorrect, defective, incompatible, or incomplete Customer-supplied product is billable.
35. Work Performed by Others
Warranty service under an APS workmanship warranty must be authorized by APS.
If another contractor or unauthorized party alters, modifies, repairs, disconnects, or otherwise affects APS's work, applicable
APS warranty coverage may be denied to the extent the third party's actions caused, contributed to, or prevent APS
from reasonably evaluating the claimed failure.
CUSTOMER RESPONSIBILITIES
36. Customer Responsibilities
Customer agrees to:
Provide accurate information reasonably known about the property's systems
Provide safe access
Maintain equipment
Replace filters as required
Follow manufacturer operating requirements
Secure pets
Notify APS about hazardous conditions
Notify APS about chemical drain cleaners
Avoid unauthorized modifications to warranted work
Promptly report concerns following service
Make payment according to agreed terms
37. Pets, Children & Work Area Safety
Customer is responsible for keeping pets, children, and other occupants safely away from active work areas, tools,
equipment, open panels, excavations, and other service hazards.
APS may suspend work if a safe work area cannot be maintained.
SAFETY
38. Safety & Right to Refuse or Stop Work
APS may refuse, postpone, or stop work when APS reasonably determines that conditions are:
Unsafe
Unsanitary
Structurally dangerous
Hazardous
Unlawful
Threatening to employees
Inconsistent with applicable safety requirements
APS will not knowingly bypass required safety devices, applicable codes, or lawful safety procedures merely because a
Customer requests it.
39. Hazardous Materials
Unless specifically contracted and legally authorized, APS does not provide remediation of:
Asbestos
Lead
Mold
Biological contamination
Hazardous chemicals
Other regulated hazardous materials
If suspected hazardous materials are encountered, APS may suspend work until the condition has been appropriately
evaluated or made safe.
DOCUMENTATION & COMMUNICATION
40. Photographs, Video & Service Documentation
APS may photograph or record:
Equipment
Model and serial numbers
Components
Work areas
Existing conditions
Deficiencies
Progress
Completed work
Documentation may be used for:
Customer records
Quality control
Warranty processing
Training
Insurance
Safety
Internal business purposes
APS will not intentionally publish personally identifying Customer information for marketing purposes without appropriate
permission.
41. Electronic Communications
Customer authorizes APS to communicate regarding scheduling, service, estimates, invoices, warranties, and account
matters by reasonable electronic methods including email and text message when contact information has been provided.
Marketing communications remain subject to applicable law and applicable consent requirements.
LIABILITY & EXISTING CONDITIONS
42. Pre-Existing & Concealed Conditions
To the fullest extent permitted by law, APS is not responsible for loss or damage resulting solely from:
Pre-existing defects
Hidden deterioration
Previously leaking systems
Mold or contamination existing before APS's work
Improper prior installation
Existing code violations
Structural defects
Failure of components APS did not service or replace
Nothing in these Terms eliminates liability that cannot lawfully be waived.
43. Secondary Damage
APS is not responsible for pre-existing water damage, mold, rot, structural deterioration, or other consequential conditions
caused by a failure occurring before APS's arrival.
Customer should promptly address active water leaks and take reasonable steps to protect the property from additional
damage.
44. Limitation of Liability
To the fullest extent permitted by applicable law, APS will not be liable for indirect, incidental, special, punitive, or
consequential damages arising solely from equipment failure or conditions outside APS's contracted scope.
Where legally enforceable, APS's contractual liability arising from a specific service shall not exceed the amount paid to APS
for the service giving rise to the claim.
This limitation does not apply where applicable law prohibits such limitation and is not intended to exclude liability for
conduct that cannot legally be disclaimed or limited.
INSURANCE
45. Insurance Claims
Customer remains responsible for payment to APS regardless of whether an insurance company:
Approves a claim
Denies a claim
Delays payment
Pays less than APS's invoice
APS may provide invoices, photographs, or service documentation reasonably available to assist Customer, but APS does not
guarantee insurance coverage or reimbursement.
MECHANIC'S LIEN RIGHTS
46. Mechanic's Lien & Statutory Notices
APS reserves all lawful payment, collection, and mechanic's-lien rights available under Iowa law.
For residential construction property, Iowa law may require specific notices, filings, and deadlines before mechanic's-lien
rights can be exercised.
These Terms do not replace any statutory notice required by Iowa law.
APS may provide or file separate notices when necessary to preserve applicable rights.
DISPUTES
47. Customer Concerns
APS wants an opportunity to address concerns before they escalate.
Customer should notify APS promptly if Customer believes:
Work was incomplete
A repair did not resolve the approved issue
An invoice is incorrect
A warranty may apply
Property was damaged
Customer agrees to provide APS a reasonable opportunity to inspect the claimed issue before another contractor alters or
repairs APS's work when reasonably possible.
48. Dispute Resolution
The parties agree to first attempt in good faith to resolve disputes directly.
If the parties cannot resolve a dispute, they may mutually agree to mediation.
Unless the parties enter into a separate enforceable arbitration agreement, disputes requiring formal adjudication may be
brought in a court having lawful jurisdiction.
These Terms are governed by Iowa law, except to the extent federal law controls.
Nothing in this section eliminates any consumer right or remedy that cannot lawfully be waived.
FORCE MAJEURE
49. Events Beyond APS's Control
APS is not responsible for unreasonable delay caused by events beyond its reasonable control, including:
Severe weather
Natural disasters
Supply-chain interruption
Manufacturer delays
Material shortages
Transportation delays
Utility interruption
Government action
Permit or inspection delays
Labor disruptions
Emergencies
APS will resume affected work as reasonably practical.
GENERAL TERMS
50. Changes to Authorized Work
Changes requested by Customer after approval may change both the price and completion schedule.
Additional work requires authorization before being performed except where immediate action is reasonably necessary to
protect life or safety and otherwise permitted by law.
51. Entire Agreement
The applicable:
APS proposal or estimate
Service ticket
Approved change order
Applicable warranty
Maintenance agreement
Financing documents, if applicable
These Terms
collectively constitute the agreement concerning APS's work.
If a specific written proposal conflicts with these general Terms, the more specific written provision controls for that work

52. Severability
If a court determines that one provision of these Terms is unlawful or unenforceable, that provision shall be limited or
removed only to the extent necessary, and the remaining provisions will remain effective to the extent permitted by law.
53. No Waiver of Statutory Rights
Nothing in these Terms is intended to waive, restrict, or eliminate any right, disclosure, cancellation period, warranty right,
consumer protection, or remedy that applicable Iowa or federal law does not permit the parties to waive.
54. Acceptance
By electronically approving, signing, or otherwise lawfully authorizing APS to perform services, Customer acknowledges
receipt and acceptance of these Terms, subject to all applicable statutory rights.
