Terms and Conditions of Service

These Terms and Conditions (“Terms”) apply to all estimates, proposals, invoices, work orders, service calls, repairs, installations, maintenance, inspections, and other services (“Services”) provided by Advanced Problem Solutions (APS). By authorizing APS to perform Services, accepting a quote, signing a work order, scheduling service, or paying an invoice, you (“Customer”) agree to these Terms.

1. Estimates, Quotes & Authorization

  • Estimates and quotes are based on visible conditions at the time of inspection and information provided by the Customer. Hidden, concealed, or previously undisclosed conditions may require additional work and cost.

  • Quotes are typically valid for a limited time and may change due to material price increases, availability, or scope changes.

  • Authorization to proceed may be provided by signature, electronic approval, text, email, recorded phone approval, or payment. Authorization allows APS to perform the agreed-upon Services.

  • Any work outside the original scope will require Customer approval and may result in additional charges.

2. Scope of Work

  • APS is responsible only for the specific Services described in the approved estimate or work order.

  • APS is not responsible for:

    • Pre-existing conditions

    • Code violations not directly related to the scope of work

    • Work performed by others

    • System failures or damages outside the agreed scope

  • In plumbing, drain cleaning, and HVAC work, APS cannot guarantee the condition of concealed piping, wiring, ductwork, or components not accessible during service.

3. Payment Terms

  • Payment is due upon completion of service, unless otherwise agreed in writing.

  • APS accepts approved forms of payment, which may include cash, check, credit card, or financing (if available).

  • Past-due balances may be subject to late fees, interest, collection costs, and/or suspension of future services.

  • Customer agrees to pay all costs of collection, including attorney fees, if payment is not made as agreed.

4. Deposits & Special Orders

  • Deposits may be required for large projects, equipment orders, or special-order materials.

  • Special-order equipment or materials are typically non-refundable once ordered.

  • Cancellations after materials are ordered may result in restocking or cancellation fees.  Inquire about job specific cancellation fees before approving as they cannot be waived.

5. Scheduling, Access & Delays

  • Customer is responsible for providing safe, clear, and timely access to the work area.

  • APS is not responsible for delays caused by:

    • Customer unavailability

    • Weather conditions

    • Supply chain delays

    • Acts of nature

    • Unsafe working conditions

  • Additional charges may apply if technicians are unable to perform work due to access or site conditions, including but not limited to additional trip charges.

6. Plumbing & Drain Cleaning Specific Terms

  • Drain cleaning clears blockages at the time of service only. APS does not guarantee against future clogs. At the time of clearing, we do recommend additional camera inspections and total home packages to ensure all lines are properly cleaned out and there is no damage, improperly installed or broken piping (inside or outside) the home.

  • APS is not responsible for:

    • Broken, deteriorated, collapsed, or offset pipes

    • Damage caused by existing pipe conditions

    • Backup or flooding due to underlying system defects

  • Camera inspections provide a visual snapshot of conditions at the time of inspection and do not guarantee future performance.

7. HVAC Specific Terms

  • APS does not guarantee the performance of existing equipment beyond the work performed.

  • Proper operation depends on factors including system age, ductwork condition, electrical supply, gas supply, insulation, and maintenance.

  • Manufacturer warranties apply only when equipment is installed, operated, and maintained according to manufacturer requirements.

8. Warranty

  • APS workmanship warranties, if provided, apply only to labor performed by APS and only for the stated period.

  • Warranties do not cover:

    • Normal wear and tear

    • Misuse, abuse, neglect, or improper maintenance

    • Work performed by others

    • Acts of nature or conditions outside APS control

  • Manufacturer warranties are subject to manufacturer terms and registration requirements.

9. Limitation of Liability

  • APS’s liability is limited to the amount paid for the specific Services provided.

  • APS is not liable for indirect, incidental, special, or consequential damages, including loss of use, loss of profits, or property damage beyond the scope of work.

10. Acts of Nature & Unforeseen Events
APS is not responsible for delays, damages, or failures caused by events beyond its control, including but not limited to:

  • Floods, storms, freezing, fire, earthquakes

  • Power outages or utility failures

  • Supply chain disruptions

  • Government actions or code changes

11. Safety & Property Protection

  • APS takes reasonable care to protect the Customer’s property; however, some Services involve inherent risks (cutting, drilling, excavation, drain cleaning).

  • Customer is responsible for removing or protecting personal property near work areas.

12. Right to Refuse or Stop Work
APS reserves the right to refuse or stop work if:

  • Conditions are unsafe

  • Required approvals are not provided

  • Payment terms are not met

  • Customer behavior is abusive or threatening

13. Disputes & Governing Law

  • Any disputes shall be governed by the laws of the state in which the Services are performed.

  • Customer agrees to attempt good-faith resolution before pursuing legal action.

14. Entire Agreement
These Terms, together with the approved estimate or work order, constitute the entire agreement between APS and the Customer. No verbal statements modify these Terms unless confirmed in writing.
15. Acceptance
By signing, approving, scheduling, or paying for Services, the Customer acknowledges they have read, understand, and agree to these Terms and Conditions.
